Accelerating the Improvement of China's Comprehensive Transportation Law and Regulation System

Recently, the General Office of the Ministry of Transport issued "Key Points of Transport Legal Work in 2019" (referred to as "Key Points"), which clearly accelerated the improvement of comprehensive transport laws and regulations, continued to deepen the reform of "release and control uniforms", better play the fundamental, stable expectations, long-term security role of the rule of law, and provide a solid legal guarantee for the construction of a powerful transportation country.


The Key Points clearly stipulates that the Ministry's comprehensive transport laws and regulations system should be adjusted and perfected in time. According to the Outline of Building a Transport Power, the legislative items and implementation steps determined by the Ministry's Implementation Opinions on Improving the Comprehensive Transport Law and Regulations System should be adjusted and perfected so as to better serve the strategy of strengthening the transport power. Around the central decision-making and deployment, we will actively promote the legislative process of key laws and administrative regulations in the industry, formulate and implement the "Ministry of Transport's Legislative Plan for 2019", focusing on "one law and two regulations", and promote the legislative process of drafting and revising the highway law. We will speed up the revision of a number of regulations in key areas and formulate and revise a number of departmental regulations urgently needed in railway, highway, waterway, civil aviation, postal and other fields. Strengthen the study of the rule of law, strengthen the study of transport legislation, law enforcement and legal work, organize and carry out the research work of comprehensive transport laws and regulations, toll roads, road transport and other important management systems, and post-evaluation of maritime law, so as to provide theoretical support for the establishment of key laws and administrative regulations.


The Key Points put forward that we should continue to deepen the reform of "release and control uniforms", and do a good job in revising relevant regulations and regulations around the reform of administrative examination and approval system, the reform of "separation of certificates" and the new requirements of security development. We will do a good job in the new batch of work to cancel the examination and approval of decentralization, timely collate the practice and experience of "double random and one open" supervision, guide the reform of "separation of licenses" in transportation, and further consolidate and deepen the work of clearing up and standardizing all kinds of penalties, inspections and fees related to enterprises in the field of transportation.
